What to Do If You're in Bankruptcy and Your Home Was Hit By a Tornado

Both Lee and Barbour counties are located within the Middle District of Alabama. Many lives were affected yesterday by the tornadoes that swept through Lee and Barbour counties. Our thoughts and prayers are with the families and communities affected by the tornadoes for their lives will be forever changed by these tornadoes.

As most Alabamians know by now, there were multiple fatalities and injuries suffered by those in our communities yesterday. Currently, in Lee County, some people are still missing after the tornado so please take a moment to pray for those missing and that they will be recovered. Also, please pray for those searching for these individuals and the first responders.

What do I do if I cannot make my bankruptcy hearing?

Call your attorney to ask to have your hearing continued to a date when you can attend.

What do I do if I cannot make my chapter 13 payment?

Call your attorney to see about having your chapter 13 payments excused for a period of time due to the impact of these disasters. The court may excuse a certain number of payments BUT that does not shield you from your creditors pursuing action in court against your property.

Can I make an insurance claim?

Yes, you may make an insurance claim to have your home/cars replaced. If any insurance money is to come to you directly and you are in chapter 13, you must notify your attorney before spending any of these funds.

  • Governor’s Emergency Relief Fund: This is a “fund of last resort” for the unmet needs of families trying to recover from disasters within our state. The money received is managed through The United Ways of Alabama.
